This involves compiling a detailed chronology of events and gathering strong case facts. Under Indonesian Civil Procedural Law and the Civil Code, collateral seizures allow courts to issue protective orders to prevent asset concealment before the verdict. These measures can lead to executory seizures (sita eksekusi), which play a crucial role in securing victories and recovering losses effectively.

The former director of one of our clients was found to have orchestrated a series of fraudulent practices within the accounting team. This included instructing the team to duplicate sales, prematurely recognize revenue from payments that had not been received, understate actual expenses, and inflate asset valuations.

The new director, supported by the commissioners and shareholders, has been assigned the responsibility of recovering the financial losses caused by this fraud and initiating efforts to recover the misappropriated assets.

Our initial assessment revealed that the former director, identified as the fraudster, was uncooperative and refused to acknowledge his actions. Consequently, we pursued a robust asset recovery strategy that involved both criminal and civil actions.
